1. Introduction

Welcome to The Voltas privacy policy. The Voltas ("we", "us", or "our") respects your privacy and is committed to protecting your personal data. This privacy policy aims to give you information on how we collect and process your personal data through your use of this website (thevoltas.com), including any data you may provide when you sign up for our membership services or subscribe to our newsletter.

Age Restriction

This website and our services are intended for individuals aged 18 and over. We do not knowingly collect data relating to children. If we become aware that we have collected personal data from a child under the age of 18, we will take steps to delete that information.

2. The Data We Collect About You

Personal data, or personal information, means any information about an individual from which that person can be identified. We may collect, use, store, and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity Data: Includes your name, username or similar identifier, display name, and date of birth (where required for age verification).
  • Contact Data: Includes your email address. We do not generally collect physical addresses unless specifically required for a customer support resolution.
  • Technical Data: Includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.
  • Profile Data: Includes your username and password (encrypted), purchases or orders made by you, your interests, preferences, and feedback.
  • Usage Data: Includes information about how you use our website and services, collected via tools such as Google Analytics 4 (GA4).
  • Marketing and Communications Data: Includes your preferences in receiving marketing from us and your communication preferences.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data).

3. How We Use Your Personal Data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Performance of Contract: Where we need to perform the contract we are about to enter into or have entered into with you (e.g. providing access to The Voltas membership content).
  • Legitimate Interests: Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests (e.g. for running our business, provision of administration and IT services, network security, and fraud prevention).
  • Legal Obligation: Where we need to comply with a legal obligation (e.g. tax reporting).
  • Consent: Generally, we do not rely on consent as a legal basis for processing your personal data except in relation to sending third-party direct marketing communications to you via email. You have the right to withdraw consent to marketing at any time.

4. Disclosures of Your Personal Data

We do not sell your personal data. However, we may share your personal data with the parties set out below for the purposes set out in section 3:

  • Service Providers (Processors): We use third-party processors to facilitate our services. This includes Memberstack (for membership management and authentication), Webflow (for website hosting), and email delivery services. These processors act on our behalf and are contractually bound to protect your data.
  • Payment Processors: All financial transactions are handled by third-party payment providers (such as Stripe). We do not store full credit card details on our servers.
  • Analytics Providers: We use Google Analytics 4 to understand website traffic and usage patterns.
  • Professional Advisers: Including lawyers, bankers, auditors, and insurers based in the UK who provide consultancy, banking, legal, insurance, and accounting services.
  • Regulators: HM Revenue & Customs, regulators, and other authorities who require reporting of processing activities in certain circumstances.

5. International Transfers

Some of our external third parties (including our hosting and membership providers) are based outside the United Kingdom (UK), so their processing of your personal data will involve a transfer of data outside the UK.

Whenever we transfer your personal data out of the UK, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

  • The country has been deemed to provide an adequate level of protection for personal data by the UK government.
  • We use specific contracts approved for use in the UK (such as the International Data Transfer Agreement or "IDTA") which give personal data the same protection it has in the UK.

Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorised way, altered, or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors, and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

Data Retention

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements.

By law, we may be required to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for tax purposes.

Under the UK GDPR and Data Protection Act 2018, you have rights in relation to your personal data, including the right to:

  • Request access to your personal data (a "data subject access request").
  • Request correction of the personal data that we hold about you.
  • Request erasure of your personal data.
  • Object to processing of your personal data where we are relying on a legitimate interest.
  • Request restriction of processing of your personal data.
  • Request the transfer of your personal data to you or to a third party.
  • Withdraw consent at any time where we are relying on consent to process your personal data.

You have the right to make a complaint at any time to the Information Commissioner's Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk). We would, however, appreciate the chance to deal with your concerns before you approach the ICO, so please contact us in the first instance.
